  • "Kitchen Owner" refers to businesses or individuals who register to provide food services
  • "Customer" refers to users who place orders through the Platform
  • "Services" refers to all services provided by Matbakh

3. User Accounts

3.1 Registration

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Kitchen Owner Responsibilities

Kitchen Owners must:

  • Comply with all applicable health, safety, and food handling regulations
  • Provide accurate information about menu items, ingredients, and pricing
  • Prepare and package orders with proper food safety standards
  • Honor all confirmed orders placed through the Platform
  • Maintain appropriate business licenses and permits
  • Respond promptly to customer inquiries and resolve issues

5. Orders and Payments

5.1 Placing Orders

All orders placed through the Platform are subject to acceptance by the Kitchen Owner. We reserve the right to refuse or cancel any order for any reason.

5.2 Pricing

All prices are displayed in the local currency and include applicable taxes unless otherwise stated. Delivery fees are determined by the Kitchen Owner and displayed before order confirmation.

5.3 Payment

Payment must be made at the time of order placement using the payment methods available on the Platform. You authorize us to charge your selected payment method for the total order amount.

5.4 Cancellation and Refunds

Cancellation and refund policies are determined by individual Kitchen Owners. Please review the specific policy before placing your order. Refunds are processed according to the applicable cancellation policy.

6. Delivery

Delivery services are provided by Kitchen Owners or their designated delivery partners. Estimated delivery times are approximate and not guaranteed. We are not responsible for delays caused by factors beyond our control.

7. Intellectual Property

The Platform and its content, including but not limited to text, graphics, logos, images, and software, are the property of Matbakh or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, or distribute any content from the Platform without our express written permission.

8. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others or engage in fraudulent activities
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Interfere with or disrupt the Platform's operation
  • Use the Platform for any commercial purpose without our consent

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATBAKH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES ARISING OUT OF YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Matbakh and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Platform, violation of these Terms, or infringement of any rights of another party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration authority.
